Abstract
Європейський Союз позиціонує свою економічну модель на принципах відкритого ринку та вільної конкуренції, що означає, що ціни товарів і послуг у нормальних умовах формуються ринковими силами попиту і пропозиції, без прямого втручання держави. Засадничою метою правової системи ЄС є забезпечення «відкритої та вільної конкуренції» на внутрішньому ринку. Формування цінової політики в ЄС відбувається під впливом фундаментальних принципів вільного ринку, закріплених у договорах ЄС, але водночас враховує соціально-економічні цілі та конкретні обставини. Європейська Комісія та держави-члени шукають баланс між необхідністю розвитку конкуренції та забезпеченням публічних інтересів, дотримуючись при цьому правових рамок ЄС, що проявляється у гнучкому підході – за нормальних умов ціни залишаються ринковими, а в разі потреби застосовуються обмежені й обґрунтовані інструменти впливу на ціноутворення. Особливості формування цінової політики в країнах ЄС базуються на принципах “висококонкурентної соціальної ринкової економіки”, що дозволяє успішно балансувати між ринковою ефективністю та соціальною справедливістю. Кризові події 2022-2024 років продемонстрували ефективність застосування різноманітних інструментів цінового регулювання у відповідь на енергетичні та продовольчі шоки. Досвід Німеччини, Франції та Польщі показав важливість координованого підходу до стримування цін через прямий контроль, субсидії, регуляторні рамки та специфічне галузеве регулювання. Чинні моделі регулювання цін у ЄС, незважаючи на свою загальну ефективність, потребують вдосконалення через недостатню гнучкість у періоди високої інфляції, високе регуляторне навантаження на бізнес та обмежені можливості національних регуляторів впливати на глобальні цінові коливання.
The European Union positions its economic model on the principles of an open market and free competition, meaning that the prices of goods and services are normally determined by market forces of supply and demand, without direct state intervention. The fundamental aim of the EU legal system is to ensure “open and free competition” in the internal market. Pricing policy in the EU is shaped by the fundamental principles of the free market enshrined in the EU treaties, but at the same time takes into account socio-economic objectives and specific circumstances. The European Commission and the Member States seek a balance between the need to develop competition and ensure public interests, while respecting the EU legal framework, which is manifested in a flexible approach – under normal conditions, prices remain market-based, and if necessary, limited and justified instruments of influence on pricing are used. The peculiarities of pricing policy formation in the EU are based on the principles of a "highly competitive social market economy", which allows for a successful balance between market efficiency and social justice. The crisis events of 2022-2024 demonstrated the effectiveness of using various price regulation instruments in response to energy and food shocks. The experience of Germany, France and Poland has shown the importance of a coordinated approach to containing prices through direct control, subsidies, regulatory frameworks and specific sectoral regulation. Current price regulation models in the EU, despite their overall effectiveness, need improvement due to insufficient flexibility during periods of high inflation, high regulatory burden on business, and limited ability of national regulators to influence global price fluctuations.
