Особливості зовнішньоекономічного договору у видавничій діяльності

Abstract

У статті досліджено теоретичні та практичні засади авторських договорів та особливості зовнішньоекономічного договору у видавничій діяльності. Виявлено актуальність та необхідність укладання видавничих договорів з обов’язковим дотриманням права інтелектуальної власності на результати творчої діяльності авторів. Проаналізовано два види найпоширеніших зовнішньоекономічних договорів: ліцензійного договору (договору на використання) та про передачу майнових прав. Визначено переваги та недоліки кожного з договорів. Розглянуто особливості оподаткування за зовнішньоекономічним договорами для резидентів та нерезидентів також використання податкових пільг, які передбачені міжнародними договорами між Україною та країнами резиденції осіб.The article examines the theoretical and practical principles of copyright agreements and features of foreign trade agreement in publishing. The urgency and necessity of concluding publishing agreements with obligatory observance of intellectual property rights to the results of creative activity of Аuthors is revealed. Intellectual property rights protect authors and grant them personal intangible and property rights. Two types of the most common foreign economic agreements are analyzed: the license agreement (agreement for use) and the transfer of property rights. The advantages and disadvantages of each of the agreements are identified. The peculiarities of taxation under foreign economic agreements for residents and non-residents as well as the use of tax benefits provided by international agreements between Ukraine and the countries of residence of persons are considered. It is proved that the proposal to establish an institute of editorial (publishing) law deserves detailed research and discussion among scholars, taking into account the current legislation of Ukraine and the need for meaningful elaboration of sufficient and necessary terms of the contract to meet the needs of the Publisher and the Author.
