Правові особливості наближення екологічного нормативного регулювання якості вод в Україні до вимог ЄС

Abstract

Досліджуються еколого-правові інструменти українського та європейського визначення, оцінювання та регулювання якості поверхневих вод: нормативи якісного стану водних об’єктів та нормативи лімітування надходження до них забруднювальних речовин з техногенних джерел, якими забезпечується реалізація екосистемного принципу у сучасному водному законодавстві. Метою статті є визначення відповідності зазначених правових інструментів українського та європейського водних законодавств. Прийняття закону про інтегроване запобігання та контроль промислового забруднення, подібного директиві ЄС, та встановлення екологічних нормативів якості води, що відповідають Водній рамковій директиві ЄС, започаткувало принципові зміни української системи нормативного регулювання якості води. Визначено, що змінами здійснено майже повний перехід від застарілої української парадигми регулювання якості вод за принципом «емісія – іммісія» до європейського «комбінованого підходу». Найбільше правове значення має відмова від розрахункового визначення нормативів гранично допустимих викидів забруднювальних речовин як інструмента правового регулювання допустимого розбавлення у водному об’єкті. Натомість лімітування викидів здійснюється за характеристиками найкращих доступних технологій та екологічними стандартами якості води. Виявлено, що переклади джерел європейського законодавства містять відмінності від оригіналів, що викликають негативні еколого-правові наслідки. Результати полягають у визначенні доктринального характеру змін, що сталися в українському водному законодавстві, у виявленні джерел колізій, невідповдностей та помилкових рішень, а також напрямів та шляхів подальших змін. Зроблено висновки, що законодавчими змінами 2024 р.: 1) створено інституційні засади та нормативно-методичну базу, подібну водному законодавству ЄС; 2) головними правовими регуляторами забруднювального впливу стають нормативи гранично допустимих викидів (скидів), а головними правовими регуляторами цільового (екологічного) стану українських поверхневих вод – екологічні нормативи якості води, подібні європейським екологічним стандартам якості.

Environmental and legal instruments of Ukrainian and European definition, assessment and regulation of surface water quality are being studied, namely: standards for the quality of water bodies and standards for limiting the entry of pollutants into them from man-made sources, which ensure the implementation of the ecosystem principle in modern water legislation. The aim of the article is to assess the compliance of the specified legal instruments with Ukrainian and European water legislation. The adoption of the law on integrated prevention and control of industrial pollution, similar to the EU directive, and establish of environmental water quality standards that correspond to the EU Water Framework Directive, initiated fundamental changes in the Ukrainian water quality regulatory system. After the changes were made, the almost complete transition from the outdated Ukrainian paradigm of water quality regulation based on the «emission – immission» principle to the European «combined approach» was concluded. The greatest legal significance is the rejection of the estimated determination of standards for maximum permissible emissions of pollutants as a tool for legal regulation of permissible dilution in a water body. Instead, emission limitation is carried out based on the characteristics of the best available technologies and environmental water quality standards. It was discovered that the translations of sources of European law have differences from the originals, which cause negative environmental and legal consequences. The results comprise in determining the crucial nature of the changes that have occurred in Ukrainian water legislation, in identifying the sources of conflicts, inappropriate and erroneous some decisions, as well as the directions and ways of further changes. It was concluded that the legislative changes of 2024 created institutional foundations and a regulatory and methodological base similar to the EU water legislation, where the main legal regulators of pollutant impact are the norms of maximum permissible emissions (discharges). Additionally, it was fined that the main legal regulators of pollutant impact are the norms of maximum permissible emissions (discharges). Also, the main legal regulators of the target (environmental) state of Ukrainian surface waters are the ecological norms of water quality, similar to European ecological quality standards.
