Законодавче регулювання викидів промислових підприємств у поверхневі води – структурні та понятійні особливості

Abstract

У статті досліджено особливості правового регулювання скидання речовин у поверхневі води, які визначаються прийнятим у 2024 р. мультисекторним Законом України «Про інтегроване запобігання та контроль промислового забруднення» (Закон), спрямованим на імплементацію Україною Директиви 2010/75/ЄС. При цьому не скасовується існування й використання українського регулювання скидання забруднювальних речовин від видів діяльності, не зазначених у Законі. Наразі реалізація Закону здійснюється в умовах наближення водного законодавства України до законодавства водного сектору ЄС (Водної рамкової директиви ЄС – ВРД). Узгодження вимог цих найбільш широкомасштабних розділів екологічного законодавства ЄС створює значні проблеми. Метою статті є виявлення термінологічно-понятійних та структурних особливостей механізму законодавчого регулювання викидів речовин за інтегрованим довкіллєвим дозволом Закону та їх порівняння з відповідним українським механізмом скидання забруднювальних речовин на етапі наближення до ВРД за дозволом на спеціальне водокористування. У водокористуванні з паралельним (одночасним) існуванням двох механізмів регулювання скидання – за інтегрованим дозволом та за дозволом на спеціальне водокористування, виникає цільова невизначеність: європейське та українське регулювання ґрунтуються на різних наукових парадигмах – еколого-центричній та економіко-центричній відповідно. Зазначені правові інструменти можуть застосовуватися як в межах одного водного об’єкта, так і в діяльності одного водокористувача на різних промислових майданчиках. Виявлено: істотні розбіжності Закону з Водним кодексом України стосовно сфер регулювання – види промислової діяльності й категорії зворотної води, понять «речовина» й «забруднення», фізичних показників скидів та викидів, а також термінологічні некоректності Закону щодо факторів регулювального впливу («вивільнення» й «викид»). Зроблено висновок, що український механізм регулювання скидання забруднювальних речовин на сучасному етапі наближення до ВРД істотно відрізняється від європейського відповідника та вимог, визначених Законом. The article examines the features of the legal regulation of discharges of substances into surface waters, which are determined by the multi sectoral Law of Ukraine “On Integrated Prevention and Control of Industrial Pollution” (the Law), adopted in 2024, aimed at the implementation of Directive 2010/75/EU by Ukraine. At the same time, the existence and use of Ukrainian regulation of discharges of pollutants from activities not specifid in the Law is not canceled. Currently, the implementation of the Law is carried out in the context of the approximation of Ukrainian water legislation to the legislation of the EU water sector (the EU Water Framework Directive – WFD). Harmonization of the requirements of these most extensive sections of EU environmental legislation creates signifiant problems. The aim of the article is to identify the terminological, conceptual and structural features of the mechanism of legislative regulation of emissions of substances under the integrated environmental permit of the Law and compare them with the corresponding Ukrainian mechanism of discharges of pollutants at the stage of approximation to the WFD under a permit for special water use. In water use with the parallel (simultaneous) existence of two mechanisms for regulating discharges – under an integrated permit and under a permit for special water use, there is a target uncertainty: European and Ukrainian regulation are based on diffrent scientifi paradigms – ecologically-centric and economically-centric, respectively. The specifid legal instruments can be applied both within the same water body and in the activities of one water user at diffrent industrial sites. The following were identifid: signifiant discrepancies between the Law and the Water Code of Ukraine regarding the areas of regulation – types of industrial activity and categories of return water, the concepts of “substance” and “pollution”, physical indicators of discharges and emissions, as well as terminological inaccuracies of the Law regarding regulatory impact factors (“release” and “emission”). It is concluded that the Ukrainian mechanism for regulating discharges of pollutants at the current stage of approximation to the WFD signifiantly diffrs from the European counterpart and the requirements specifid by the Law.
