Особливості представництва корпоративної організації її органами у зовнішніх відносинах

Abstract

Стаття присвячена правовідносинам представництва інтересів корпоративної організації її органами у зовнішніх відносинах. У ній викладені існуючі у юридичних колах концепції представництва юридичної особи її органами. Розглянута компетенція виконавчого органу (правління) корпоративної організації, закріплена в законодавстві України. Окреслені особливості представництва інтересів корпоративної організації виконавчим органом у зовнішньокорпоративних відносинах. Запропоновані зміни до норм чинного законодавства з цього питанняThe article regards legal relations of representation of interests of corporative organization by its organs in outer relations. It presents the concepts of representation of juridical person by its organs existing in legal circles. The article considers the competence of an executive organ (board) of a corporative organization, which is confirmed by the Law of Ukraine. The peculiarities of representation of interests of a corporative organization by an executive organ in extra-corporative relations are outlined, as well as suggestions are made concerning changes of the norms of current Laws touching on this problem.
